Terms of Use

These Terms of Use ("Terms") govern your use of the Turn Off PC mobile application (the "App"), published by Marcos Salas ("I", "me", "my"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What the app does

The App lets you send power commands (shut down, restart, sleep and wake) to computers you have set up, over your local network, over a VPN or over an internet connection you control. To do this, the target computer must run the Turn Off PC Desktop application or the Turn Off PC Server, which are distributed separately and have their own terms.

The App sends commands directly from your phone to your computer. I do not operate any intermediate server, and I have no access to your computers or to the commands you send.

2. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country (14 in Spain, up to 16 elsewhere in the European Economic Area), to use the App. If you are below the age of majority in your country, you may only use the App with the consent of a parent or guardian.

3. Acceptable use

You may only use the App to control computers that you own, or that you have express authorisation from the owner to control. Using it to shut down, restart or otherwise interfere with somebody else's computer without their permission may be unlawful in your country, and you are solely responsible for such use.

You agree not to:

• Use the App to disrupt, damage or gain unauthorised access to any system or network.
• Copy, modify, translate, decompile, reverse engineer or attempt to extract the source code of the App, except to the extent that applicable law expressly permits it.
• Rent, lease, sell, sublicense, redistribute or otherwise transfer the App.
• Remove or alter any copyright, trademark or other proprietary notice.
• Use the App in breach of any applicable law, or of the terms of the app store you obtained it from.

4. Your setup and your responsibility

You are responsible for how you configure the App and your network, including any router configuration, port forwarding, dynamic DNS or VPN you choose to use, and for keeping those configurations secure. Exposing a computer's ports to the open internet carries security risks that only you can assess and accept.

You are also responsible for the security of your mobile device. Rooting or jailbreaking your device, or installing the App from a source other than an official app store, may compromise its security and the security of the computers you control with it.

5. Risk of data loss — please read

Shutting down, restarting or suspending a computer remotely can cause the loss of unsaved work, interrupt file transfers, downloads, backups, renders, updates or scheduled tasks, and in rare cases corrupt files that were being written at that moment. Forced commands close applications without giving them the chance to save or to prompt you.

You accept this risk. Before sending a command, make sure that no important work is in progress on the target computer, and keep your own backups. To the fullest extent permitted by law, I am not liable for any loss of data, work, files or time resulting from commands you send through the App, including commands sent accidentally, from a home screen widget, from a Quick Settings tile or by any other shortcut.

6. Free version, advertising and paid plans

The App is free to download. The free version is supported by advertising and limits the number of computers you can configure. Optional purchases remove advertising and unlock additional features, including an unlimited number of devices and controlling several devices at once.

• All payments are processed by Google Play or the Apple App Store. I never receive your payment details.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You manage and cancel subscriptions in your Google Play or App Store account settings, not through the App.
• Refunds are handled exclusively by Google or Apple under their own policies. I cannot issue refunds on their behalf.
• One-time and lifetime purchases give you access for as long as the App remains available and technically able to operate. "Lifetime" refers to the lifetime of the App, not to yours, and does not oblige me to keep the App running indefinitely.
• Your purchases are tied to the app store account you bought them with, and can be restored on your other devices through that account.
• Prices, plans and the features included in each plan may change. Any change to the price of an existing subscription will be notified to you in advance, and you may cancel before it takes effect.
• I may change the features available in the free version, but I will not remove a feature you have already paid for.

7. Availability, updates and compatibility

I may update, modify or discontinue the App, or any of its features, at any time. Updates may be required for the App to keep working correctly.

The App depends on things outside my control: your network, your router, your internet provider, your VPN, your operating system, your computer's hardware and firmware, and the app stores themselves. Wake-on-LAN in particular depends on your network card, BIOS/UEFI and router configuration, and does not work on every setup. I do not warrant that the App will work with every device, network or configuration, that it will be available without interruption, or that it will be free of errors.

8. Intellectual property

The App, its design, its name, its logo and all associated content are owned by Marcos Salas and are protected by intellectual property law. I grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on devices you own or control, for your own purposes, in accordance with these Terms. No other rights are granted.

9. Third-party services

The App includes third-party components and services, such as advertising, analytics, crash reporting and purchase management. Their processing of your data is described in the Privacy Policy, and their own terms apply to it. The App may also link to external websites, which I neither operate nor control.

10. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement, to the fullest extent permitted by applicable law.

Nothing in these Terms excludes or limits the statutory rights of consumers under mandatory law, including the legal guarantee of conformity.

11. Limitation of liability

To the fullest extent permitted by applicable law, I will not be liable for any indirect, incidental, special or consequential damages, nor for loss of data, loss of profit, loss of business or loss of opportunity, arising out of or in connection with your use of, or inability to use, the App.

Where liability cannot be excluded, my total aggregate liability is limited to the greater of the amount you paid for the App in the twelve months preceding the event, or ten euros (EUR 10).

Nothing in these Terms excludes or limits my liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

12. Termination

You may stop using the App at any time by uninstalling it. I may suspend or terminate your right to use the App if you materially breach these Terms. Termination does not entitle you to a refund of purchases already made, except where required by law, and does not affect any right you may have against Google or Apple under their own policies.

13. Changes to these Terms

I may update these Terms from time to time. The updated version is published on this page, and the "Last updated" date is revised. Changes take effect when published. If a change is significant and affects your rights, I will make reasonable efforts to notify you within the App. Continuing to use the App after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by Spanish law. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of that country. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.

15. Additional terms for Apple devices

If you obtained the App from the Apple App Store, the following also applies:

• These Terms are concluded between you and me only, not with Apple. Apple is not responsible for the App or its content.
• The licence granted to you is limited to using the App on any Apple-branded product that you own or control, as permitted by the App Store Terms of Service.
• I, and not Apple, am solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any support services.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• I, and not Apple, am responsible for addressing any claim relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• I, and not Apple, am responsible for the investigation, defence, settlement and discharge of any third-party claim that the App infringes that third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
